Data protection fees to increase by 29.8%

Data Protection, News,

Following a consultation in 2024, the fees payable by data controllers to the Information Commissioner’s Office (ICO) will be increased by 29.8%. This is in response to a consultation that ran last year in which one of the considerations was increasing fees by 37.2%.

The new fees will be as follows:

Tier Applicable to:Current feeNew fee
Micro organisations – maximum turnover of £632,000 or no more than 10 members of staff£40£52
Small and medium organisations – maximum turnover of £36 million or no more than 250 members of staff£60£78
Large organisations which do not meet criteria for tier 1 or 2£2,900£3,763

The increase in the level of fees is the first since 2018, and though high, the outcome of the consultation states that the increase in fees is still below the compounded inflationary increases between that last increase and the end of 2024. The Tier 1 fee has remained unchanged since 2000.

There is a £5 discount for direct debit payments and any organisations that are currently exempt from paying the fee will continue to be exempt.

The aim is for the new fees to take effect in ‘early 2025’ once the required legislation has been passed by Parliament.
